I suppose that I should leave well enough alone and NOT post anything online ever again... but let's face it. Somewhere along the way we were all taught that thousands of brave men and women fought to provide us with Freedom of Speech, and lets face it FREEDOM.
I guess that only applies to the people with the power, because we are not in fact allowed to express ourselves in any fashion that remotely involves another person, company, or entity of any kind.
It was suggested to me to look up the definition of slander, because even by referral one can slander another... without using names. I have looked but have not found anything of that particular statement. Before I go on... let me explain.
On the 16th of February I sat next to a loved one who was very ill. This person has had more than a rough go and the doctors were threatening to put this person in the hospital because of the stress they were under and depression. I am fairly knowledgeable about what goes on in their world and have had many opportunities to see / hear much of it first hand. I quoted two specific occurances. Without names or specifics.... Things that I have actually seen and heard with my own eyes and ears. I commented on them and expressed MY opinion.
This loved one comes to me and tells me that the people whom I commented on are holding her accountable. It was suggested that they should get control of me. Ultimately they believe that it is slander. So.... upon direction I looked it up.
slander n. oral defamation, in which someone tells one or more persons an untruth about another which untruth will harm the reputation of the person defamed. Some statements such as an untrue accusation of having committed a crime, having a loathsome disease, or being unable to perform one's occupation are treated as slander per se since the harm and malice are obvious, and therefore usually result in general and even punitive damage recovery by the person harmed. Words spoken over the air on television or radio are treated as libel (written defamation) and not slander on the theory that broadcasting reaches a large audience as much if not more than printed publications. (See: defamation, fair comment)
Written words are not slander because they were not SPOKEN.
libel
An untruthful statement about a person, published in writing or through broadcast media, that injures the person's reputation or standing in the community. Because libel is a tort (a civil wrong), the injured person can bring a lawsuit against the person who made the false statement. Libel is a form of defamation , as is slander (an untruthful statement that is spoken, but not published in writing or broadcast through the media).
AGAIN: not libel because they were not False statements.
My statements were not false! They were true to what I heard and saw. They were not hearsay. There was no malice involved, just an extremely frustrated person over what a loved one's environment consisted of.
I have since then been "banned from the property" where the environment is... and again have opinions as to that situation but for obvious reasons will keep them to myself. I would love to put my opinions out for the benefit of others, but as I have more than learned.... it is our loved ones who suffer the consequences of our actions. It is those whom we strive to protect that endure the pains of our actions.
